Did anyone watch Dateline..about Debt Collectors?
Wondering if anyone else watched Dateline a couple of weeks ago, they had a special on Debt Collectors. We have all heard horror stories, but the footage that Dateline had was unreal! One company impersonated the police department in MD, saying the police was on their way to pick them up. Another lady (I use this term lightly for that woman) asked the debtor on the answering machine "Have you ever been raped?", I took this as a threat to the debtor.
My question is do you think this is typical behavior for most collection agencies, or were these a few bad apples?
Yes, I watched that special. I thought they did a pretty good exposing the debt collection industry for what it really is. Alot of these shows, unfortunately, don't get very aggressive with the collection industry.
Is this typical behavior for debt collectors? Absolutely! The collection agencies use fear and intimidation as their primary methods of collecting money. As was mentioned in that special, the FTC receives more complaints about debt collectors than any other business combined, and the federal government had to pass the Fair Debt Collection Practice Act because of their business practices. You're be hard pressed to find a collection agency that is "decent"...some are just worse than others.
Alot the reason for this is that the FDCPA was written in the 70's and as such it's $1000 liability per lawsuit is very small, meaning that the debt collectors can still be profitable with their intimidation tactics since very few consumers know their rights and sue to enforce them. The FTC needs to get with the times and update the FDCPA so that it's not profitable for debt collectors to ignore the law.
Also, you have to look at the people who work in debt collection. Most collection agencies are call centers with very low pay and high turnover rates, and an overwhelming majority of the employees and unskilled, uneducated and/or have a criminal record. Heck, look at the guy who OWNED the one collection agency that was featured. He was a convicted felon! While I forget exactly what he had been convicted of, I know it was related to banking and money. Suffice it to say that man should NEVER have been allowed to own a business where he has access to such confidential and personal information.
Also, that job also seems to attract people who use it to satisfy some kind of mafia fetish. Just on a whim a few months back, I ran a search on Myspace for debt collectors and around 80% of their personal pages made significant references to the mob.
Things like this are the reason I, and many others, come here to help consumers. Alot of them are like I was about a year ago, afraid of debt collectors and thinking there was no way to fight them, but I learned that we had rights and now I'm here helping others to educate themselves.

Edit: Boy, I just love self-righteous people like Jay who show up here and want to dump all this in the consumer's lap. Seriously, what can you say about a kid who reads a question where debt collectors were impersonation police officers (a CRIMINAL act) and threatening them with rape, yet he finds fault with the consumer who failed to pay a bill?!? One that may or may not even be legitimate?!?

Newsflash Jay! Debt collectors like the ones shown in this special are violating both CIVIL AND CRIMINAL LAW! There is absolutely nothing "criminal" about failing to pay a bill either. The fact that you lay blame on the consumer is nothing short of mind-boggling!
You say you've never had a bill collector come after you, and to that I say "good." I just hope you never have a serious accident, lose a job or any of the million things that can come up and effect your ability to pay bills, because even as ignorant as your statement was, I hope you never are in a position where you have to go through what these people went through.
