Is the standard size and shape of a guitar pick (eg. the dunlop tortex) patent protected?
What if i design a guitar pick that is the same size and shape as other guitar picks on the market? can i patent mine?
I don't know if it is, you would have to ask the U.S. patent office to be sure. Given that patents only last 20 years and that guitar picks have been around longer then that I would assume that they are not patented but again you would have to check with the U.S. Patent office to be sure. Another way to check is to buy one of the picks you are referring to and see if it has any notice on it about patent protection.
If the standard size is patented you may not patent another pick that does the exact same thing and is the same size and shape. This is exactly what patents are meant to protect. Even if they are no longer patented or even if they never were patented you may not patent your own version of the pick because it is already out in the public domain.
If however, you make some unique design and put it on a pick and sell it as your own you may be entitled to copyright protection. Also, if you directly copied someone elses unique design you may be infringing on their copyrights. Copyrights last about 90 years or so and you do not have to register to get one or to be infringing on one. But just to be clear, you would only have protection on the unique design you add not in the pick itself.
